Fraud & Identity Theft Charges

In Canada, fraud is defined as “lying or deceiving to make a profit or gain an advantage, or to cause someone else a loss or disadvantage.” Identity theft cases are similarly defined as the fraudulent acquisition and use of another’s private information, often for financial gain. Both fraud and identity theft are highly complicated in nature, and should be defended by experienced legal counsel.

In the majority of fraud or identity theft cases, the Crown must prove that the defendant knew such an act was prohibited, and that the alleged victim faced some level of deprivation due to the act. As such, many effective defence avenues exist for this type of offense.
